1. Service Description

Santa Visit ("we", "us", "our") is operated by Peter Howard, trading as Real Santa Video, a sole trader based in the United Kingdom. By accessing or using this website and purchasing a service, you agree to be bound by these Terms & Conditions.

We provide an AI-powered service that creates personalised videos featuring Santa Claus appearing in photos you provide.

2. Definitions

• "Santa Tech™" means our proprietary combination of software engineering, prompt design, workflow optimisation, model selection, and quality checks used to produce your personalised Santa video as reliably and realistically as current AI allows.
• "AI Models" means third-party artificial intelligence models and services used to generate video and/or audio content.
• "Order" means your purchase of a single personalised video generated from the photo and options you submit.
• "Video" means the personalised digital video output we generate and make available for download.

3. AI-Generated Content

Please read this section carefully.

• Our videos are created using artificial intelligence (AI) via AI Models and Santa Tech™.
• We may use third-party providers to generate and host your Video (which may include services such as Google AI models and AWS cloud storage in European data centres).
• AI-generated results are variable by nature and we cannot guarantee specific outcomes, exact likeness, or frame-by-frame accuracy.
• The appearance, movement, and integration of Santa in your Video may vary.
• Results depend significantly on the quality, lighting, composition, and suitability of the photo you provide.
• The Video produced may differ from the supplied source image due to AI constraints and variability.
• By purchasing, you acknowledge and accept that AI output cannot be precisely controlled or predicted.
• We may change or update the AI Models and/or infrastructure providers we use to improve quality, performance, reliability, or availability.

4. Photo Requirements & Your Responsibility

For best results, your photo should be:

• A clear, well-lit indoor photograph
• In landscape orientation
• Showing visible floor space for Santa to walk through
• Free from obstructions in Santa's intended walking path
• Of reasonable resolution (not blurry or pixelated)

By uploading a photo, you confirm that:

• You own the photo or have permission to use it
• The photo does not contain inappropriate, illegal, or offensive content
• You accept that poor quality or unsuitable photos will affect the final Video quality
• You understand that video quality issues resulting primarily from unsuitable photos are not grounds for a refund

5. Pricing & Payment

• Both Santa Walk Visit and Special Delivery services are priced at £4.99
• Payments are processed securely via Stripe or PayPal
• All prices are shown in GBP
• VAT will only be charged if and when required by UK law
• Payment must be completed before video generation begins
• Each purchase provides access to a single AI-generated personalised video

6. Service Delivery

• Videos are typically generated within a few minutes of payment (though times can vary)
• Videos are 8 seconds long
• Once your Video is generated and made available for download, the service is considered complete and delivered
• Videos are available for download for 30 days after creation
• We recommend downloading your Video immediately upon completion
• We are not responsible for Videos not downloaded within the 30-day period
• Data Retention: Your uploaded photos and generated Videos will be permanently deleted 30 days after successful Video creation, ensuring you have adequate time to download and back up your Video

7. Refund Policy

Due to the digital and AI-generated nature of our service:

Refunds ARE available if:

• We fail to deliver any Video (complete technical failure)
• The delivered Video is corrupted, unplayable, or blank
• There is a clear technical malfunction on our part that we cannot resolve
• Ticking the Terms and Conditions on checkout you ask us to start making your video immediately. You’ll will lose your 14-day right to cancel once processing starts as this is a digital product.

Refunds are NOT available for:

• Subjective dissatisfaction with the AI-generated result ("I don't like how it looks")
• Poor results caused by unsuitable or low-quality uploaded photos
• Variations in AI output quality that are inherent to AI technology
• Change of mind after purchase once generation has started and/or the Video has been delivered
• Videos that have been successfully generated and made available for download (except where the Video is corrupted, unplayable, or blank)

To request a refund for eligible issues, please contact us within 14 days of purchase with your order ID and a description of the problem.

Nothing in these Terms limits your statutory rights under the Consumer Rights Act 2015 in relation to digital content.

8. Digital Content & Cancellation

Your purchase is for personalised digital content (a Video). By completing payment, you request that we begin generating your Video right away. You acknowledge that once generation/supply has begun, you may lose any right to cancel that would normally apply to digital content. This does not affect your rights if we fail to deliver your Video or if the Video is corrupted, unplayable, or blank—in which case we will work with you to fix it or refund it in line with these Terms.

9. Usage Rights

Once you purchase a Video:

• You receive a non-exclusive licence to use the Video for personal, non-commercial purposes
• You may share it with family and friends
• You may post it on personal social media accounts
• You may NOT resell, redistribute commercially, or claim the Video as your own creation
• You may NOT use the Video for commercial purposes without our written permission

10. Intellectual Property

• All content, branding, software, and generated media associated with the Real Santa Video service remain the intellectual property of Real Santa Video (operated by Peter Howard), unless otherwise stated
• You retain ownership of the original photos you upload
• The generated Video is licensed to you under the terms above

11. Limitation of Liability

• Our total liability is limited to the amount you paid for the service, to the extent permitted by law
• We are not responsible for any indirect, incidental, or consequential damages
• We do not guarantee that the service will meet your specific expectations
• We are not liable for disappointment resulting from normal AI variability
• We make no warranties, express or implied, regarding the quality or suitability of AI-generated content
• Nothing in these Terms limits or excludes liability where it would be unlawful to do so (including for fraud).

12. Acceptable Use

You agree not to:

• Upload illegal, harmful, or inappropriate content
• Attempt to manipulate or abuse our service
• Use the service for any unlawful purpose
• Reverse engineer or attempt to extract our AI technology

13. Data Processing

Personal data submitted in connection with this service is processed in accordance with our Privacy Policy.

Peter Howard, trading as Real Santa Video, acts as the data controller.

Scotchegg Digital Ltd may act as a data processor and technical service provider, supporting hosting, deployment, and system maintenance only.

14. Changes to Terms

We may update these terms from time to time. The version in effect at the time of your purchase will apply to that transaction. Continued use of the service after changes constitutes acceptance of the new terms for future purchases.

15. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
